How California State Disability Insurance and paid family leave work
Two programmes funded by the same payroll deduction, covering different situations. Most employees do not know they have either until they need one.

Two of the most useful benefits available to California employees are among the least understood, partly because they share a funding mechanism and get conflated.
What each covers
**State Disability Insurance** pays partial wage replacement when you cannot work because of your own illness, injury, pregnancy or childbirth, where the cause is not work-related. Work-related injury goes through workers' compensation instead, which is a separate system.
**Paid Family Leave** pays partial wage replacement when you take time off to care for a seriously ill family member, to bond with a new child, or for certain military family circumstances.
How the benefit is calculated
The payment is a percentage of wages during a base period, which is a defined earlier stretch of employment rather than your current pay. Someone whose earnings recently rose may receive less than expected; someone recently returned to work may not have enough base-period earnings to qualify at all.
There is a maximum weekly benefit, so higher earners receive a smaller proportion of their income.
The job protection gap
This is the point that causes the most harm. Neither programme is job protection. They provide money, not the right to return to your role.
Job protection comes from separate laws with their own eligibility conditions based on employer size and length of service. An employee can be entitled to wage replacement and not to reinstatement, or the reverse.
“Check the leave protection separately from the pay. They are different questions with different answers.”
Practical points
- Apply promptly; there are filing deadlines and a waiting period.
- Gather medical certification early, since it is the usual cause of delay.
- Check your base period before assuming an amount.
- Ask your employer in writing which job-protected leave you are on, and keep the reply.
